How Long Is an Immigration Waiver Valid?

Many immigrant waivers are valid indefinitely—but that statement is only the beginning of the analysis. A waiver ordinarily covers only the specific inadmissibility grounds and the related crimes, events, incidents, or conditions identified in the application. It does not erase the underlying history, forgive later misconduct, or automatically apply to every future immigration benefit.

Other waivers are temporary, conditional, benefit-specific, or not yet effective. K-1 and K-2 waivers depend on the qualifying marriage. Certain waivers tied to conditional residence can end if that status is terminated. A provisional unlawful-presence waiver does not take effect upon approval. INA §212(d)(3) nonimmigrant waivers are limited by dates, entries, classification, purpose, and conditions.

This page addresses validity after approval. It does not determine whether a waiver was legally available or whether an inadmissibility finding was correct.

The Core Rule

Most Immigrant Waivers Are Indefinite—but Not Unlimited

Under 8 C.F.R. §212.7(a)(4), an immigrant waiver generally continues indefinitely, even if the person later abandons or otherwise loses lawful permanent resident status. Its substantive scope remains confined to what the approval actually waived.

Indefinite Duration

For most waivers granted in connection with an immigrant visa or adjustment of status, there is no routine expiration date. A person ordinarily does not need to reapply merely because years have passed or because permanent resident status was later abandoned or lost.

This rule can protect the applicant in later immigrant or nonimmigrant matters involving the same waived ground and the same disclosed incidents.

Limited Scope

The approval applies only to the inadmissibility grounds and related crimes, events, incidents, or conditions specified in the waiver application. An omitted event, different offense, later false statement, new unlawful presence period, or new removal can require separate analysis and possibly a new waiver.

An approval notice should never be summarized merely as “all inadmissibility waived.”

Indefinite does not mean erased, universal, or irrevocable. The factual record remains. Future applications still require truthful disclosure, and USCIS may reopen and reconsider an approval determined to have been issued in error.

Scope Before Duration

What Exactly Did the Government Waive?

Before asking whether an approval has expired, identify the statutory and factual boundaries of the decision.

Ground of Inadmissibility

Confirm every statutory subsection listed in the application, referral, request for evidence, decision, and agency record. A waiver of INA §212(a)(6)(C)(i) does not automatically waive INA §212(a)(9)(B), §212(a)(9)(A), or another ground.

Underlying Incident

Identify the particular conviction, false statement, period of unlawful presence, medical condition, removal, or other conduct included in the application. A different incident may fall outside the approval.

Immigration Benefit

Determine whether the waiver was issued for an immigrant visa, adjustment, K visa, TPS, refugee admission, T or U status, nonimmigrant admission, or another category. Carry-forward rules differ.

Conditions and Effective Date

Read for marriage conditions, removal of conditions, departure and interview requirements, entry limitations, medical follow-up, service obligations, or other terms that delay or restrict effectiveness.

Use the complete filing, not only Form I-797. The form, legal brief, declarations, criminal records, consular referral, RFE response, approval notice, and agency notes may all matter when determining the incidents and grounds actually placed before the adjudicator.
Immigrant Waivers

Indefinite Validity After Permanent Residence Is Granted

The ordinary rule is unusually durable. A qualifying immigrant waiver remains valid even if the person later abandons or otherwise loses permanent resident status.

Later Immigrant Application

If a former permanent resident later pursues a new immigrant visa and the same waived ground arises from the same disclosed incident, the prior waiver may continue to resolve that ground. The new petition and all other requirements must still be satisfied.

Later Nonimmigrant Travel

USCIS policy states that a waiver granted in connection with lawful permanent resident status permanently waives the covered ground for future immigration-benefit applications, including immigrant and nonimmigrant benefits. The traveler must still qualify for the requested classification and admission.

Loss of LPR Status

Abandonment, rescission, removal, or another loss of status does not automatically extinguish an ordinary indefinite waiver. The reason status was lost may itself create a new issue or reveal that the original grant was invalid.

A prior waiver cannot cure an unlawful grant of residence outside its scope. If a material ground was omitted, the wrong person qualified as the statutory relative, the approval was legally unavailable, or the decision never became effective, later proceedings may revisit lawful admission.
Fiancé and Child Cases

K-1 and K-2 Waiver Validity Depends on the Petitioning Marriage

A K waiver is approved in anticipation of a specific marriage. The regulation makes the long-term validity of that waiver depend on the K-1 marrying the U.S. citizen petitioner.

If the K-1 Marries the Petitioner

The waiver becomes valid indefinitely, subject to the special conditional-residence rule where applicable. It can remain valid even if adjustment is not ultimately completed or permanent resident status is later lost.

The marriage must be to the U.S. citizen who filed the fiancé petition—not merely any U.S. citizen.

If the Qualifying Marriage Does Not Occur

The K-1 and K-2 remain inadmissible for applications or benefits based on something other than the proposed marriage. A later marriage, employment petition, or different family petition does not automatically inherit the prior K waiver.

A new waiver filing may be required if the ground remains waivable under the later category.

Document the qualifying marriage permanently. Keep the marriage certificate, petition approval, K visa, admission record, waiver filing, and approval because later agencies may need to verify that the condition for indefinite validity was satisfied.
Conditional Residence

Waiver Validity Before and After Removal of Conditions

A waiver connected to conditional permanent residence may not yet have the same finality as a waiver tied to unconditional residence.

Conditions Removed

When the conditions on residence are removed, the waiver generally becomes valid indefinitely, even if permanent resident status is later abandoned or lost.

Conditional Status Terminated

Termination of conditional residence also terminates a waiver under INA §212(h) or §212(i) that was granted to the conditional resident. A separate waiver-termination notice is not required.

Status Restored in Proceedings

If the person challenges termination in removal proceedings and the proceedings end with restoration of conditional residence, the waiver becomes effective again.

Do not assume every conditional-resident waiver is treated identically. The exact ground, approval basis, termination procedure, and outcome of any I-751, I-829, rescission, or removal matter must be reviewed.
Provisional Unlawful Presence

An Approved I-601A Is Not Effective Yet

Form I-601A creates a two-stage validity problem: approval occurs in the United States, but legal effectiveness ordinarily begins only after consular processing reaches the required point.

USCIS approves the provisional waiver

The approval does not grant lawful status, employment authorization, advance parole, admission, or immediate forgiveness of unlawful presence.

The applicant departs for immigrant visa processing

Departure should occur only after the immigrant visa appointment is properly scheduled and the record has been screened for every possible additional ground and procedural obstacle.

The applicant appears for the immigrant visa interview

The consular officer conducts an independent eligibility and admissibility determination.

The Department of State finds the applicant otherwise eligible

Only then does the provisional waiver take full effect. Once effective, the covered unlawful-presence period is waived indefinitely.

Automatic revocation can occur before effectiveness. Examples include a visa denial after the completed interview for another reason, failure of the underlying petition, termination of immigrant visa registration, or an unlawful entry or attempted reentry after filing and before the waiver takes effect.
Temporary Travel

INA §212(d)(3) and Form I-192 Waivers Expire

A nonimmigrant waiver is advance permission to seek temporary admission despite a covered inadmissibility ground. It is not the equivalent of an indefinite immigrant waiver.

Validity Dates

The authorization specifies the dates on or between which the traveler may apply for admission. A waiver outside those dates cannot ordinarily be revalidated.

Number of Entries

The authorization may be limited to one entry, a specified number of entries, or multiple entries. A visa’s reciprocity limits may be shorter than the waiver authorization.

Purpose and Classification

The authorization identifies the purpose of the trip and nonimmigrant context. A different classification, materially different activity, or immigrant application may require separate relief.

Revocation

The authorization is subject to revocation at any time. New arrests, false statements, immigration violations, security information, or changed facts can affect future use.

Waiver validity is not visa validity or admission duration. The waiver, visa, passport, petition, and I-94 each perform different legal functions and can have different expiration dates.
Benefit-Specific Waivers

TPS, Refugee, T, U, and Other Humanitarian Cases

Humanitarian statutes often contain their own admissibility and carry-forward rules. An approval granted for one humanitarian benefit should not be assumed to function as a universal waiver.

Temporary Protected Status

A waiver approved in connection with TPS is temporary and generally lasts for the duration of TPS. It can apply to later TPS re-registration requests but ordinarily does not waive inadmissibility for adjustment, an immigrant visa, another nonimmigrant classification, or admission on a different basis.

Refugee Admission and Adjustment

A waiver granted for refugee admission generally carries forward to adjustment under INA §209, so a second waiver is not normally required for the same ground. A new Class A medical finding can require another waiver, and adjustment on a basis other than INA §209 may require relief under that separate category.

T Nonimmigrant Adjustment

USCIS guidance generally permits the adjustment officer to defer to a previous T-waiver decision and consider the ground waived for the T adjustment application, unless new facts, changed circumstances, or the scope of the original decision requires renewed analysis.

U and Other Special Categories

U, V, S, legalization, VAWA, special immigrant juvenile, asylum, and other programs may use different waiver statutes and standards. Review the governing provision and approval terms rather than importing the ordinary Form I-601 rule automatically.

The form number alone does not determine validity. Form I-601 can be used in several statutory settings, and Form I-192 can involve ordinary nonimmigrant, T, U, or other procedures. The benefit and legal authority control.
Health Grounds

Medical Waivers Can Remain Conditional

Medical inadmissibility waivers frequently depend on compliance with health, financial, treatment, vaccination, or public-safety arrangements rather than a simple expiration date.

Post-Arrival Evaluation

The approval may require the applicant to report to an identified facility or specialist and complete an evaluation within a stated period after arrival.

Treatment or Monitoring

The applicant may need to comply with examinations, outpatient or inpatient care, treatment plans, counseling, or public-health monitoring.

Financial Assurances

A sponsor or responsible person may be required to arrange payment, provide assurances, or post a bond for treatment and related expenses.

New Medical Examination

A later medical examination can identify a new or continuing Class A condition. Refugees with a prior medical waiver may need a new waiver at adjustment.

Compliance is part of validity. Keep the approval, medical documents, proof of reporting, treatment records, vaccination compliance, financial arrangements, and agency communications.
Related but Different Relief

Form I-212 and J-1 Waivers Have Separate Rules

These remedies are often discussed with inadmissibility waivers, but their legal effects should not be confused with an ordinary Form I-601 approval.

Consent to Reapply After Removal

Form I-212 grants permission to reapply for admission despite a covered prior-removal ground or, in some settings, the permanent bar. The effect depends on the statutory subsection, timing, whether approval was advance or retroactive, and the linked visa, adjustment, or admission request.

It does not waive fraud, crimes, unlawful presence, health grounds, alien smuggling, or another independent basis of inadmissibility.

J-1 Two-Year Residence Requirement

An INA §212(e) waiver removes the two-year foreign-residence obstacle for the approved case, but physician and interested-government-agency waivers may be conditioned on specified employment, service location, timing, and duration.

Failure to satisfy a condition can have serious status, change-of-status, visa, adjustment, and enforcement consequences.

Later Events

When a New Waiver May Be Required

A valid old waiver cannot be stretched to cover facts that were never within the original application or that arose later.

New Criminal Conduct

A later arrest, conviction, admission, controlled-substance issue, trafficking allegation, or other criminal ground requires independent analysis.

New Misrepresentation

A false answer in a later visa, adjustment, border, or naturalization proceeding is a separate event even if an earlier fraud finding was waived.

New Unlawful Presence

A later period of unlawful presence and departure may create a new INA §212(a)(9)(B) bar not covered by the earlier filing.

New Removal or Reentry

A later removal, expedited removal, reinstatement, unlawful reentry, or attempted reentry can trigger INA §212(a)(9)(A) or §212(a)(9)(C).

Omitted Prior Incident

An event that existed before approval but was not disclosed may fall outside the waiver and may also raise credibility, fraud, reopening, or rescission issues.

Different Statutory Ground

The same facts can support more than one ground. Waiver of one subsection does not necessarily resolve another subsection based on the same conduct.

Changed Benefit Category

A TPS, refugee, nonimmigrant, or humanitarian waiver may not carry into a family, employment, or other immigrant case.

Nonwaivable Ground

Some later findings have no waiver in the requested category. The strategy may require challenging the finding, changing the benefit, or pursuing a different statutory remedy.

Agency Review

Can an Approved Waiver Be Reopened, Revoked, or Terminated?

Reopening for Error

8 C.F.R. §212.7 expressly preserves USCIS authority to reopen and reconsider an approval determined to have been made in error. The agency must follow the procedures applicable to the action it takes.

Automatic or Status-Based Termination

I-601A approvals have express automatic-revocation provisions. Certain waivers tied to conditional residence terminate with termination of that status. Some petitions or humanitarian approvals have their own revocation rules.

Temporary Waiver Revocation

INA §212(d)(3) authorization is expressly subject to revocation at any time. Even without formal revocation, expiration requires a new application and authorization.

Distinguish expiration from invalidity. An indefinite waiver may still be challenged as legally unavailable, fraudulently obtained, outside its factual scope, never effective, or issued in error. Those are different questions from whether a stated validity period elapsed.
Future Filings

Using an Old Waiver in a New Immigration Case

A later officer may not have the complete earlier record or may interpret the approval differently. Present the issue affirmatively rather than assuming the government will connect the files correctly.

Obtain the complete prior file

Collect the waiver form, exhibits, legal memorandum, declarations, government referral, RFE or NOID, response, approval notice, visa record, and admission or adjustment evidence. Use FOIA where the record is incomplete.

Map the old finding to the new application

Identify the statutory ground, incident, date, agency, and benefit involved in both proceedings. Explain why the earlier approval does or does not carry forward.

Disclose the history accurately

Do not answer “no” merely because the legal effect was waived. Questions about arrests, refusals, removals, fraud findings, unlawful presence, or prior waivers usually still require truthful disclosure.

Submit proof of validity and effectiveness

Include the approval and evidence that any condition was fulfilled—such as the K marriage, removal of conditions, I-601A immigrant admission, medical compliance, or authorized nonimmigrant travel period.

Screen for new or omitted grounds

Compare all later conduct and all historical records with the original filing. Determine whether a new waiver, I-212, challenge to an incorrect finding, or record-correction strategy is needed.

Preserve alternative arguments

Where appropriate, argue that the old waiver remains valid while separately contesting an incorrect new finding or requesting alternative relief without making unnecessary factual concessions.

Government Decisions

Keep every approval, denial, reopening notice, consular refusal sheet, visa annotation, I-94, immigrant visa packet record, adjustment approval, and conditional-residence decision.

Complete Filing Copy

Preserve the exact form edition, signed application, legal argument, exhibits, translations, medical records, criminal dispositions, hardship evidence, and responses submitted.

Proof Conditions Were Satisfied

Retain marriage and admission records, I-751 or I-829 approval, medical compliance, service completion, authorized entries, employment records, and proof of any required departure or interview.

Keep the record permanently. Waiver validity can become important years later in a visa application, readmission, replacement green card matter, removal proceeding, rescission case, or naturalization review.

“The Finding Disappeared”

A waiver generally excuses the legal consequence for a covered purpose. It does not delete the underlying event from government records.

“All Grounds Were Waived”

The approval usually reaches only grounds and incidents actually specified. Related facts can support a separate ground.

“My I-601A Works Now”

A provisional waiver ordinarily remains ineffective until departure, interview, and a finding of other immigrant visa eligibility.

“My Five-Year Waiver Gives Five-Year Status”

A §212(d)(3) validity period does not determine visa validity or the period CBP authorizes on Form I-94.
